Privacy Policy

1. Who we are

NoptiK, Inc. ("NoptiK," "we," "us") is a Delaware C-Corporation headquartered in California, USA. Our website is noptik.ai. Our contact email is team@noptik.ai.

2. What information we collect

We collect three categories of information:

• Information you provide directly when you contact us, book a call, apply to the design partner program, or sign up for an account. This includes name, email address, agency name, role, and any information you choose to share.
• Information from your platform integrations when you connect ad platforms (Meta, Google, TikTok, LinkedIn) to NoptiK. This includes campaign data, performance metrics, creative assets, and other data made available through those platforms' APIs.
• Information collected automatically when you visit our website, including IP address, browser type, pages visited, and referring URLs. We use cookies and similar technologies for site analytics and to remember your preferences.

3. How we use your information

We use the information we collect to:

• Provide and operate the NoptiK service, including producing forecasts and maintaining your account;
• Communicate with you about the service, respond to inquiries, and provide customer support;
• Improve the model and the product through aggregated, differentially-private statistics — no individual record is reconstructable from aggregated data;
• Comply with legal obligations and protect our rights and the rights of our users.

4. How we share your information

We do not sell your information. We share it only:

• With service providers who process data on our behalf (cloud hosting, analytics, payment processing) under contractual confidentiality and data-processing terms;
• When required by law, valid legal process, or to protect rights, property, or safety;
• In connection with a business transaction such as a merger, acquisition, or sale of assets, in which case the acquiring entity will be bound by this policy or a substantially similar one.

5. Tenant isolation and the hive-mind

Each agency tenant's raw data lives in its own isolated Postgres schema with row-level security enforced at the database layer. There is no cross-tenant query path. The "hive-mind" — our cross-client learning layer — operates only on aggregated posterior parameters that have passed through a differentially-private aggregation step with bounded epsilon. No individual record can be reconstructed from the aggregated parameters.

6. Data retention and deletion

We retain your data for as long as your account is active or as needed to provide the service. You may request deletion of your data at any time by emailing team@noptik.ai. Your tenant schema will be dropped within 30 days of a confirmed deletion request. Aggregated, differentially-private posterior parameters from your data may persist in the shared model after deletion, but no individual record is recoverable from those parameters.

7. Security

We implement industry-standard security measures including encryption in transit and at rest, access controls, and audit logging. We are pre-launch and have not yet completed SOC 2 or ISO 27001 audits; both are on our roadmap. We do not claim certifications we have not earned.

8. Your rights

Depending on where you live, you may have rights regarding your personal information including the right to access, correct, delete, or port your data. To exercise these rights, email team@noptik.ai. We will respond within applicable legal timelines.

9. International data transfers

NoptiK is based in the United States. If you access the service from outside the U.S., your information will be transferred to and processed in the U.S., which may have different data-protection laws than your jurisdiction.

10. Children's privacy

The NoptiK service is intended for businesses and is not directed to individuals under 18. We do not knowingly collect personal information from children.

11. Changes to this policy

We may update this Privacy Policy as the service evolves. We will post the updated policy here with a new effective date and, for material changes, notify account holders by email.

Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of NoptiK ("the Service"), provided by NoptiK, Inc. ("NoptiK," "we," "us"). By accessing or using the Service, you agree to be bound by these Terms.

2. The Service

NoptiK is a Bayesian predictive analytics platform for digital ad agencies. We provide forecasting tools that produce calibrated predictions of campaign outcomes based on historical data, creative features, and live campaign data feeds. The Service is currently in private beta and is being developed in active partnership with our design partners.

3. Eligibility and accounts

You must be at least 18 years old and authorized to enter into binding contracts on behalf of your organization to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Acceptable use

You agree not to:

• Use the Service in violation of applicable law or third-party rights;
• Reverse engineer, decompile, or attempt to extract the source code of the Service except as permitted by law;
• Probe, scan, or test the vulnerability of the Service or attempt to bypass security or authentication measures;
• Use the Service to send unsolicited communications, malware, or other harmful content;
• Interfere with or disrupt the integrity or performance of the Service.

5. Your data

You retain all rights to data you submit to the Service ("Customer Data"). You grant NoptiK a limited license to process Customer Data solely to provide the Service. We will not use Customer Data for any purpose other than providing and improving the Service for you, except as required by law.

6. Fees

Design partners use the Service free of charge during the private beta. Fees for general availability will be set out in a separate order form or subscription agreement before any charges are incurred.

7. Confidentiality

Each party agrees to protect the other's confidential information with the same degree of care it uses to protect its own confidential information, and not to disclose confidential information to third parties except as necessary to perform under these Terms or as required by law.

8. Intellectual property

NoptiK retains all rights, title, and interest in and to the Service, including all software, models, methodologies, and documentation. These Terms do not grant you any rights in or to NoptiK's intellectual property except the limited license to use the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NoptiK does not warrant that the Service will be uninterrupted, error-free, or that forecasts will be accurate for any particular use case. Forecasts are statistical estimates with associated uncertainty; you are responsible for your business decisions.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NoptiK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE. NoptiK's aggregate liability under these Terms shall not exceed the greater of (a) fees paid by you to NoptiK in the 12 months preceding the claim or (b) one hundred dollars ($100).

11. Indemnification

You agree to indemnify and hold NoptiK harmless from any claims, damages, or expenses arising out of your violation of these Terms, your misuse of the Service, or your violation of any third-party rights.

12. Termination

Either party may terminate these Terms at any time. Upon termination, your right to access the Service ceases. Sections that by their nature should survive termination (including confidentiality, intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any disputes arising out of or related to these Terms shall be resolved in the state or federal courts located in Delaware, and both parties consent to the personal jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms as the Service evolves. We will post updated Terms here with a new effective date and, for material changes, notify account holders by email.
